ChatoyerDiamonds.com is owned and operated by Chatoyer Diamonds Pty Ltd ACN 648 659 134, and will be referred to as “We”, “our” and “us” in this terms and conditions. These are the terms and conditions of ChatoyerDiamonds.com. Your use of the ChatoyerDiamonds.com website confirms your agreement with our terms and conditions outlined below, including any other terms and conditions stated herein, and with any applicable laws. These terms are subject to change without notice.
PRODUCT IMAGES AND VIDEOS
We have done our best to accurately show the colours of the products/diamonds offered on this website. However, because the colour you see is dependent on your computer screen, we cannot guarantee that the colour you see will be completely accurate. The products also may appear larger or smaller than the actual size depending on your screen and your ultimate choice of purchase. Most videos and photographs have been enlarged to show detail and help our users.
PRICING OF PRODUCTS AND SERVICES
Chatoyer Diamonds Pty Ltd, attempts to prevent errors in pricing and product information, but being human mistakes can happen. If a mistake does happen, we reserve the right to fix it, and in our sole discretion, to reject or stop any order placed for that item at the incorrect price. All prices listed for Australian users are in Australian dollars and inclusive of GST.
WEBSITE’S STOCK AVAILABILITY
ChatoyerDiamonds.com stock is updated automatically when an order is placed. In rare occasions, there may be a diamond that you have selected which may not be available. This may happen due to APIs errors or website bugs. Chatoyer Diamonds Pty Ltd. will offer you a stone of the same or better characteristics as the one you originally selected. If no similar stones are available, Chatoyer Diamonds Pty Ltd will issue you a full refund.
PAYMENT DETAILS
Once you have selected your diamond and provided your shipping information, you will be directed to fill in your payment details, such as your credit card information, PayPal or POLI (for Australian users). When you are entering your payment information and placing your order, you authorise us and our third-party payment processors to debit the amount of the order to your selected payment of choice.
GRADING REPORTS AND DIAMOND CERTIFICATES
All loose diamonds on our site unless specified come with certificates and when we ship it to you, it will include the diamond certificate or Grading Report. All grading reports are created by high tech diamond laboratories and are expensive to replace or re-order. Any diamond that is returned, must have the original grading report returned with it and not damaged. If you happen not to include the diamond grading report with your return, we will charge a replacement fee of $250 AUD. This includes the shipping and insurance back and forth of the diamond to and from the laboratory as well as the cost of the certificate.

Chatoyer Diamonds Pty Ltd makes no statements or warranties about any other sites you may access via our website. If there is a link to another website, such link does not establish an approval of that site, or the products or services contained therein and is provided exclusively for your accessibility.
GOVERNING LAW
If a dispute between Chatoyer Diamonds Pty Ltd regarding your use of this site, such dispute or disagreement, shall be resolved according to the laws of Australia.
CONSUMER/USERS COMMUNICATIONS
Messages you send to us via email, letter, voicemail, or other communication relating to your use of this site shall be and remain Chatoyer Diamonds Pty Ltd property, and Chatoyer Diamonds Pty Ltd shall not be restricted in any way in its use, commercial, promotional, or otherwise. Nonetheless, Chatoyer Diamonds Pty Ltd will not use your full name in any such promotional use without your authorisation. You therefore agree that no such communication/messages will violate the rights of any third party or contain any or otherwise unlawful materials. Chatoyer Diamonds Pty Ltd may save certain messages and emails on file for promotional and marketing purposes, but we are not required to and do not retain every such communication/message.

Unless specifically written, this site, its content, or the information available on or through it is provided on an “as is” basis without warranties of any sort, either express or indirect, including warranties of title or implied warranties of merchantability or fitness for a reason. You accept that you use this site at your own risk, that you accept full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with your use of this website, and that Chatoyer Diamonds Pty Ltd and its associates shall not be liable for any damages including, indirect or consequential of any kind related to your use of this website. Exchanges and returns rights concerning such products are governed by terms provided elsewhere in this site and by applicable law. The operation of the website is done by a third-party body.
CHANGES ON CURRENT ORDERS
To process changes on orders that are already in the manufacturing process, the conditions are:
1. Manufacturing is at a stage where the order can be stopped (or has not been started)
2. Payment for the ring was made in full at time of purchase.
If these two conditions are met, the order can be changed (Style, metal) at no cost. If not, a fee of $500 AUD will be charged to cover the costs.
