TERMS & CONDITIONS
1. Promoter
1.1 This competition (“Promotion”) is conducted by Chatoyer Diamonds (ABN 82 648 659 134) of Unit 10/940 Albany Highway, East Victoria Park WA 6101 (“Promoter”).
1.2 By entering the Promotion, entrants agree to be bound by these Terms & Conditions and by Instagram's own terms of use.
2. Promotion Period
2.1 The Promotion commences on 07/09/2026 at 12:01am AWST (“Opening Date”).
2.2 Entries close on 01/10/2026 at 9:00am AWST (“Closing Date”).
2.3 Entries received after the Closing Date will not be eligible, regardless of when they were submitted.
3. Eligibility
3.1 Entry is open to Australian residents aged 18 years or over who hold a valid, genuine Instagram account.
3.2 Employees, contractors and agents of the Promoter, their immediate families, and any person directly involved in the administration, judging or conduct of the Promotion are not eligible to enter.
3.3 The Promoter reserves the right to request proof of identity and age, and to verify the eligibility of any entrant, at any time.
4. How to Enter
4.1 No purchase is necessary to enter. To enter, during the Promotion Period participants must:
a. follow @ChatoyerDiamonds on Instagram;
b. like the official competition post;
c. tag at least one (1) genuine friend, who is not themselves, in the comments of the competition post.
4.2 Each additional genuine friend tagged in a separate comment, by an entrant who has completed clauses 4.1(a)–(c), constitutes one additional entry.
4.3 Entries must identify a real, identifiable individual. Tags of fake, duplicate or bot accounts, business accounts, or accounts created solely to gain entries, will be deemed invalid and will not count as an entry.
4.4 Entrants must not spam, harass or repeatedly tag the same individual for the purpose of gaining additional entries. The Promoter may disqualify any entrant who does so.
4.5 It is the entrant's responsibility to ensure their Instagram account can receive a Direct Message from the Promoter for the duration of the Promotion Period and the notification period described in clause 7.
5. Prize
5.1 There is one (1) prize available to be won, comprising:
• one (1) 2.00ctw lab-grown diamond tennis bracelet, 14K white gold, approximately 18cm with adjustment available.
5.2 Total prize value: AUD $2,200 (including GST), based on the Promoter's current recommended retail price.
5.3 The prize is not transferable or exchangeable, and cannot be redeemed for cash, in whole or in part.
5.4 The prize will be supplied as described above and cannot be substituted by the winner, except that the Promoter may substitute a prize of equal or greater value if the advertised prize becomes unavailable for reasons beyond the Promoter's control.
6. Winner Selection
6.1 One (1) winner will be selected at random from all eligible entries received during the Promotion Period.
6.2 The draw will take place on 5th October at the Promoter's principal place of business, using a random number generator or comment-picker tool applied to all eligible entries.
6.3 The Promoter's decision as to the validity of any entry and the selection of the winner is final. This clause does not limit any right or remedy an entrant has under the Australian Consumer Law that cannot lawfully be excluded.
7. Winner Notification
7.1 The winner will be notified by Direct Message from the official @ChatoyerDiamonds Instagram account within seven (7) days of the draw.
7.2 The winner must respond to the notification within seven (7) days of it being sent.
7.3 If the winner does not respond within this period, cannot be contacted after reasonable attempts, or is found to be ineligible, the prize will be forfeited and the Promoter may conduct a redraw and select another eligible winner in the same manner.
7.4 The winner's Instagram username may be announced on the Promoter's Instagram account and/or Instagram Story.
8. Prize Delivery
8.1 The prize will be delivered within Australia only, to an address nominated by the winner, or made available for collection from the Promoter's studio by arrangement.
8.2 The Promoter will contact the winner to arrange delivery or collection following notification.
8.3 Risk in the prize passes to the winner on delivery or collection. The Promoter is not responsible for loss or delay caused by a third-party courier or postal service once the prize has been dispatched, or for a winner's failure to provide accurate delivery details.
9. Permits
9.1 The total prize pool for this Promotion does not exceed the thresholds requiring a trade promotion permit or licence in any Australian State or Territory, including the Australian Capital Territory ($3,000), South Australia and the Northern Territory ($5,000), and New South Wales ($10,000). No permit or authority number is required for this Promotion.
9.2 Despite clause 9.1, the Promoter will conduct this Promotion in accordance with the applicable conditions for exempt trade promotion lotteries in each State and Territory, including that every entry has an equal chance of winning, and that records of entries and the winner are kept for the period required by law.
10. Instagram Disclaimer
10.1 This Promotion is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc.
10.2 By entering, participants release Instagram and Meta Platforms, Inc. from any and all liability in connection with this Promotion, and acknowledge that any questions, comments or complaints must be directed to the Promoter, not to Instagram.
11. Use of Winner's Details
11.1 The Promoter may ask the winner's permission to feature their first name, Instagram handle, and a photo with the prize on the Promoter's social media, for promotional purposes reasonably connected with this Promotion. This is not a condition of receiving the prize, and the winner may decline.
12. General Conditions
12.1 No purchase is necessary to enter or win.
12.2 The Promoter reserves the right, acting reasonably, to disqualify any entry or entrant it considers to be fraudulent, misleading, offensive, or in breach of these Terms & Conditions or Instagram's own terms of use.
12.3 The Promoter reserves the right to verify entries and entrant eligibility at any time, including after the winner has been announced.
12.4 If this Promotion cannot be conducted as reasonably anticipated for any reason beyond the Promoter's control, including a technical failure of the Instagram platform, the Promoter may, to the extent permitted by law, modify, suspend, or cancel the Promotion or any part of it.
12.5 Nothing in these Terms & Conditions excludes, restricts, or modifies any guarantee, right, or remedy that an entrant has, or that the Promoter must provide, under the Australian Consumer Law or any other law that cannot lawfully be excluded.
13. Liability
13.1 To the maximum extent permitted by law, the Promoter excludes all liability (including for negligence) for personal injury, loss, or damage suffered by any entrant in connection with this Promotion or the acceptance or use of the prize, except for liability that cannot be excluded by law.
14. Privacy
14.1 Personal information collected from entrants, including Instagram username and, for the winner, contact and delivery details, is collected and used by the Promoter to conduct this Promotion, contact the winner, and arrange delivery of the prize, in accordance with the Promoter's Privacy Policy and the Australian Privacy Principles.
14.2 By entering, entrants consent to this use of their information. Entrants may request access to, or correction of, their personal information by contacting the Promoter at info@chatoyerdiamonds.com.
15. Governing Law
15.1 This Promotion and these Terms & Conditions are governed by the laws of Western Australia. Each entrant irrevocably submits to the non-exclusive jurisdiction of the courts of Western Australia in respect of any dispute arising from this Promotion.
16. Acceptance
16.1 Participation in this Promotion constitutes acceptance of these Terms & Conditions in full.
